Charter Commission -1 July 13, 2018 <br />MR. YOSHIMOTO: Yes, immediate family member, it's defined in the County <br />Code, and I'll get that for you. This is something that the Council recently <br />amended. I want to say two or three years ago, Doug? <br />CHR. ADAMS: Last year. <br />MR. YOSHIMOTO: Last year? Yeah. In-mlediate family means the employee's <br />or officer's spouse, siblings, children, grandchildren, or parents. Ms. Todd, we <br />can talk offline if you have a specific concern about— <br />MS. LEITHEAD TODD: I don't have a specific concern because none of my <br />kids and my grandchildren are too young, but there are some of us that are old <br />enough that we might have grandchildren that are of an age that have businesses. <br />And you just—sometimes, you don't know what business interests—seriously, <br />you know, I know people that don't necessarily know what all their immediate <br />family members are doing at a given time. Like my son-in-law comes from a <br />family of 12 kids. I mean they're all young, but I'm just saying that you have <br />situations where you have a huge extended `ohana, and so, this is one where I <br />don't think you necessarily want to go if you don't know. I just don't know <br />where this goes in terms of that extension. <br />CHR. ADAMS: Commissioner Adams. I understand that, but I also know what <br />the Council did. So, the Council said if you are, by the ordinance, that's where <br />that works. So, given that we are obviously going to be operating above board <br />and if there is a concern that you have someone who's identified as a family <br />member within the definition of the Code, then it's worth a conversation with our <br />attorney to determine whether or not a petition to the Board of Ethics is necessary. <br />I would point out that's only when, according to the ordinance, when there is an <br />application being made for the sale of goods and services. Otherwise, it's not an <br />issue. That's my understanding. <br />MR. YOSHIMOTO: Right, because there's another section that talks about the <br />competitive bidding process and—so yeah, we can talk later, offline. Okay, any <br />other questions for now? Okay. <br />Alright, Conflicts of Interest. No officer or employee shall take any official. <br />action directly affecting: a business or other undertaking n which that officer or <br />employee has a substantial financial interest. That's pretty straight forward. I <br />don't see that as an issue here. <br />Subsection (2), a private undertaking in which the officer or employee is engaged <br />as legal counsel, advisor, consultant, or representative, or other agency capacity. I <br />don't see that as being an issue here. Number (3), a business or undertaking in <br />which the employee knows or has reason to know that a brother, a sister, a parent, <br />an emancipated child, or a household member has a substantial financial interest, <br />Page 30 <br />
