A voice vote was taken of all Commissioners <br />present, and motion carried with five aye votes. <br />At 10: 02 a. m., the Commission went into executive session. At 10:10 a. m., it was moved by <br />Commissioner Replogle that the Commission go out of executive session. A voice vote was taken <br />of all Commissioners present, and motion carried with five aye votes. <br />The hearing reconvened for regular session at 10:12 a.m. <br />CLARKSON: Okay, we're back in regular session, and the basic reason for the executive <br />session was to discuss our legal rights and responsibilities and, in particular toward this public <br />trust doctrine. And, also our legal ability to put financial conditions on the water withdrawal. <br />So, at this time, the Chair would ask for a motion for action on, or continuance to further study <br />this matter, or give our legal counsel an opportunity to study it. <br />IKEDA: I move that we move for a continuance on this project. <br />DELA CRUZ: Second. <br />CLARKSON: It's been moved and seconded that this hearing be continued.
