32. Housing Assistance Payments (HAP): The monthly <br />assistance payment by the OHCD, which includes: <br />a. A payment to the Owner for Rent to Owner under the <br />Family’s lease; and <br />b. An additional payment to the Family if the total <br />assistance payment exceeds the Rent to Owner. <br /> A <br />33. Housing Assistance Payments Contract (HAP Contract): <br />written agreement between the OHCD and an owner for the <br />purpose of providing housing assistance payments under <br />the TBRA Program to the owner on behalf of an eligible <br />family. <br />34. Housing Choice Voucher: A document issued by a PHA <br />declaring a family to be eligible for participation <br />in the TBRA Program and stating the terms and <br />conditions for the family’s participation. (Also see <br />“Voucher” in this section.) <br />35. Housing Quality Standards (HQS): The performance <br />requirements and acceptability criteria for housing set <br />forth in 24 CFR Part 982.401-406 <br />36. HUD: The Department of Housing and Urban Development <br />or its designee. <br />37. Imputed Income from Assets: If the net family assets <br />are up to $5,000.00, the actual income from assets is <br />counted into the family's annual income. If the net <br />family assets are more than $5,000.00, the greater of <br />the following shall be used: <br />a. The actual income from assets; or <br />b. Imputed income from assets which can be obtained <br />by taking the HUD passbook rate (which HUD may <br />change from time to time) times the cash value of <br />the assets. <br />38. Lease: A written agreement between an Owner and a <br />tenant for the leasing of a dwelling unit to the <br />tenant. The Lease establishes the conditions for <br />occupancy of the dwelling unit by a Family with housing <br />assistance payments under a HAP Contract between the <br />Owner and the OHCD. <br />Rules and Regulations <br />-17- <br />0010ARslh-TBRA <br />11/01/2007 <br /> <br />
