Page 2 <br />H.B. NO.5'I <br />1 SECTION 3. Section 183-31, Hawaii Revised Statutes, is <br />2 amended to read as follows: <br />3 "§183-31 Watershed areas. The department of land and <br />4 natural resources shall determine, after public hearing held in <br />5 the same manner as provided in section 91-3, areas which are <br />6 watersheds[—]; provided that if a proposed watershed area will <br />7 be on land that is currently a game management area or public <br />8 hunting area, determination of an area to be a watershed shall <br />9 require the approval of the game management advisory commission <br />10 established pursuant to section 183D-4.5. <br />11 The term "watershed" as used in this part means (1) an area <br />12 from which the domestic water supply of any city, town or <br />13 community is or may be obtained, or (2) an area where water <br />14 infiltrates into artesian or other ground -water areas from which <br />15 the domestic water supply of any city, town or community is or <br />16 may be obtained." <br />17 SECTION 4. This Act does not affect rights and duties that <br />18 matured, penalties that were incurred, and proceedings that were <br />19 begun before its effective date. <br />20 SECTION 5. Statutory material to be repealed is bracketed <br />21 and stricken.
