Informal Hearing (Alternative II) on violation of Rule 3-8-B of the Rules and <br />Regulations of the Liquor Commission of the Department of Liquor Control <br />of the County of Hawaii, State of Hawaii, as patrons remained in the <br />licensed premises after 2:00 A.M. <br />James Tomlinson, Managing Member and General Manager, and Jill <br />(support) were present. <br />Fuke: I'd like to ask the Licensee to please identify themselves. <br />Tomlinson: I'm James Tomlinson, Managing Member of El Guapo Enterprises, General <br />Manager also. This is Jill, my girlfriend. She's here for support. <br />Fuke: Support? <br />Tomlinson: Yes, for support. <br />Fuke: And we do have an Acting Counsel who is also representative of the Department <br />as well, Brandon Gonzalez. The Licensee has selected Alternative II, admitting to the <br />allegation and waives its right to a hearing and appeal, and has requested an informal <br />hearing to present the circumstances surrounding the violation. Is there anything more <br />you'd like to add, Counsel? <br />Gonzalez: Good afternoon, Mr. Chair, Brandon Gonzalez for the Department. The <br />Complaint and Accusation in this case reads that on or about the fifteenth day of <br />October 2017, in the County and State of Hawaii, patrons remained in the licensed <br />premises of the Licensee, El Guapo Enterprises, LLC, dba Dolphin Spit Saloon, after <br />2:00 A.M., in violation of Rule 3-8-B as in Bronco, of the Rules and Regulations of the <br />Liquor Commission of the Department of Liquor Control of the County of Hawaii, State of <br />Hawai'i. Licensee has selected Alternative II, admitting to the allegation, waiving any right <br />to hearing and appeal and requests an informal hearing to present their circumstances <br />surrounding the violation. <br />Fuke: I'd like to request a motion to find the Licensee in violation of the charge. <br />Giffin: I so move. <br />Smith: Second. <br />Ms. Giffin moved that the Licensee in Case No. 2017-014, be found in <br />violation of Rule 3-8-B of the Rules and Regulations of the Liquor <br />Commission of the Department of Liquor Control of the County of <br />Hawaii, as patrons remained in the licensed premises after <br />2:00 A.M.; seconded by Mr. Smith. <br />Fuke: Is there any discussion on the charge? <br />There was no discussion from the Board Members. <br />DECEMBER 7, 2017 - LIQUOR ADJUDICATION BOARD MINUTES 3 <br />
