Fuke: If not, all those in favor please say, "Aye." <br />The Board Members voted "Aye." <br />Fuke: Chair votes "Aye." <br />Fuke: Those opposed, "Nay." <br />There was no opposition by the Board Members. <br />Fuke: Unanimously carried. <br />The motion was carried unanimously. <br />Fuke: Prior to assessing a penalty, we'd like to give you an opportunity to present your <br />side of the situation. There may be some mitigating situations where the Board is entitled <br />to consider. You have the floor. <br />Tomlinson: Thank you. I'm not disputing anything that happened. It happened as it was <br />said. The next morning, I heard from Malia, who was the MOD at the time. I stopped by <br />to speak with Kalani on Monday and found out it happened exactly as said. I just wanted <br />to come today to basically let everybody know that we take this extremely seriously. <br />We're going on four years now and a lot of things happened, but we try our best to always <br />stay focused, not become complacent, and abide by all in-house and County rules. Malia <br />was suspended for ten days. That's basically all I wanted to do, let everybody know we <br />try to do things correctly. We have good relationships with the agents outside since <br />Gerald's been here and that's awesome. I would be remiss in not asking for any leniency <br />in the penalty, just because I would. And, I want to share with everybody that this is taken <br />seriously and she was reprimanded and suspended. That's all. Thank you. <br />Fuke: Thank you very much. Are there any questions from the Board Members of the <br />violator? <br />Giffin: I have a question, but I want to stand corrected if it's out of order or improper for <br />me to ask. I can't pronounce Malia's last name. <br />Tomlinson: Chaul. <br />Giffin: Chaul. What precipitated this? Certainly she knew what time it was. Certainly <br />she knew it was a violation. What happened? <br />Tomlinson: She did. Her response to Steve Frendo was that time had gotten away from <br />her. I'm not making any excuses for her. It was Ironman night and as it states in here, <br />she had called me at about 11:00 P.M. and said, "Can I close early? There's nobody <br />here." I said, "Close, just get out of there." All the streets were blocked. She said shortly <br />after that a bunch of people came in from other places, friends. It was her birthday the <br />next day. Once again, I'm not making any excuses. She was on a remote karaoke <br />device that she hooked up to the tv. There was no drinking taking place at the time, as <br />Steve noticed. But, that's a separate violation I understand.
