V 0 <br /> W" t <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> tJo•:Xi MO4. ��\ <br /> 7rt OF.Nt,i <br /> RESOLUTION NO. 478 <br /> RESOLUTION AUTHORIZING THE TEMPORARY CLOSURE OF THE SOUTHERN <br /> ROADWAY STUB-OUT OF KA`EKA STREET IN THE DISTRICT OF NORTH KONA, <br /> COUNTY AND STATE OF HAWAII. <br /> WHEREAS, pursuant to Section 24-153.3, Subsection(b) of the Hawaii County Code <br /> 1983 (2016 Edition, as amended), "the Council by resolution, in consultation with the chief of <br /> police and the director of public works, may authorize the temporary closure of a roadway stub- <br /> out, dead-end and/or road terminus...", subject to certain conditions; and <br /> WHEREAS, Ka`eka Street is a County road that extends north and south from <br /> Manawalea Street in the district of North Kona, County and State of Hawaii, and is depicted and <br /> attached hereto as Exhibit"A"; and <br /> WHEREAS, residents of Lei Kupuna and Lei `Ghana at Kamakana Villages have <br /> complained that the roadway stub-out at the south end of Ka`eka Street provides unlimited <br /> access to convenient and unrestricted areas for activities that compromise public safety, <br /> including loitering, littering, consumption of alcohol, and other illegal activities; and <br /> WHEREAS, closure of the southern roadway stub-out of Ka`eka Street would not affect <br /> the flow of traffic or public access, and adjacent landowners are in support of the same and have <br /> been provided with written notification regarding the purpose and need for this temporary <br /> closure, which notification letter is attached hereto as Exhibit`B"; and <br /> WHEREAS, the Chief of Police and the Department of Public Works have been notified <br /> and have expressed approval of the temporary closure of the southern roadway stub-out of <br /> Ka`eka Street, which notification letter is attached hereto as Exhibit"C"; and <br /> WHEREAS, in order to reduce acts of loitering, littering, and illegal consumption of <br /> alcohol, and to promote a safer and cleaner community that can be fully enjoyed and embraced <br /> by its residents, the County Council finds that the southern roadway stub-out of Ka`eka Street <br /> should be temporarily closed and barricaded; now, therefore, <br />
