oJa<v os N1 °• <br /> COUNTY OF HAWAII •f•' �' � STATE OF HAWAII <br /> OF'N' <br /> RESOLUTION NO. 69 23 <br /> A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE,AND NATURAL <br /> RESOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO <br /> POHAHA I KA LANI. <br /> WHEREAS, Section 10-16 of the Hawai`i County Charter establishes a Public Access, <br /> Open Space, and Natural Resources Preservation Maintenance Fund(hereinafter"Maintenance <br /> Fund") "to preserve the land, promote public safety, and maintain a healthy stewardship"; and <br /> WHEREAS, Section 10-16(h) of the Hawai`i County Charter provides that the <br /> Maintenance Fund may be used for a stewardship grant program for properties purchased via the <br /> Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 <br /> nonprofit organizations to apply for grant-in-aid project funding for stewardship projects; and <br /> WHEREAS, Pohaha I Ka Lani is a 501(c)3 nonprofit organization whose mission is to <br /> revitalize and advance indigenous Hawaiian culture; and <br /> WHEREAS, Pohaha I Ka Lani submitted a Maintenance Fund stewardship grant <br /> application in 2019 to continue providing land stewardship and cultural education for the <br /> Waipi`o Valley Lookout, which is situated in the Hamakua District (TMK: (3) 4-8-004:006), and <br /> acquired via the Public Access, Open Space, and Natural Resources Preservation Fund after <br /> adoption of Resolution No. 427-06; and <br /> WHEREAS, during its September 9, 2019 meeting, and pursuant to section 2-217 of the <br /> Hawai`i County Code 1983 (2016 Edition, as amended), the Public Access, Open Space, and <br /> Natural Resources Preservation Commission forwarded a positive recommendation for this <br /> project to the Director of Parks and Recreation; and <br /> WHEREAS, Communication No. 267, issued by the Director of Parks and Recreation on <br /> May 7, 2021, submitted for the Council's consideration five applicants for stewardship grants for <br /> various properties that have been acquired by the County using the Public Access, Open Space, <br /> and Natural Resources Preservation Fund; and <br /> WHEREAS, Communication No. 267.2, issued by the Director of Parks and Recreation <br /> on December 15, 2021, submitted amended budget proposals that revised the original budget <br /> proposals by removing activities that may trigger the need for an Environmental Impact <br /> Statement, indirect and incidental costs that would not be covered by the grant award, and <br /> activities that would require governmental permits; and <br /> WHEREAS, the Director of Parks and Recreation in Communication No. 267.2 <br /> recommends that Pohaha I Ka Lani will be able to complete its project in accordance with the <br /> project description submitted and in strict adherence to the conditions governing the Public <br /> Access, Open Space, and Natural Resources Preservation Maintenance Fund; and <br />
