COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. 179 <br /> ,(DRAFT 2) <br /> ORDINANCE NO. 24 62 <br /> AN ORDINANCE AMENDING CHAPTER 16, ARTICLE 3, SECTION 16-5, OF THE <br /> HAWAII COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO <br /> COMMUNITY DEVELOPMENT PLAN ACTION COMMITTEES. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Chapter 16, article 3, section 16-5, of the Hawai`i County Code 1983 <br /> (2016 Edition, as amended), is amended by amending subsection(a) to read as follows: <br /> "(a) The CDP action committee shall consist of nine members. All members shall have a <br /> [primary] principal residence in the area covered by the CDP. The determination of <br /> "principal residence" shall be in accordance with criteria described in chapter 19, <br /> section 19-71(e) of this Code, however, there is no requirement that a member own <br /> property. The members shall be appointed by the mayor and approved by the <br /> County council. Prior service as a member of a CDP steering committee shall not <br /> disqualify an individual from serving on the CDP action committee." <br /> SECTION 2. Material to be repealed is bracketed and stricken.New material is <br /> underscored. In printing this ordinance, the brackets, bracketed and stricken material, and <br /> underscoring need not be included. <br /> SECTION 3. Severability. If any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br /> applications of the ordinance that can be given effect without the invalid provision or <br /> application, and to this end the provisions of this ordinance are severable. <br /> SECTION 4.
