„{V OF <br />COUNTY OF HAWAI`I STATE OF HAWAPI <br />.. -. <br />h OV r� <br />RESOLUTION NO. 370 25 <br />A RESOLUTION AUTHORIZING AND DIRECTING THE DISPOSITION AND <br />CONVEYANCE OF A ROAD REMNANT, BEING A PORTION OF TAX MAP KEY NO. <br />(3) 2-2-037:999, SITUATED AT WAIAKEA, DISTRICT OF SOUTH HILO, ISLAND, <br />COUNTY, AND STATE OF HAWAI°I. <br />WHEREAS, the County of Hawaii, a municipal corporation of the State of Hawaii, <br />(hereinafter "the County”) owns a certain road remnant (hereinafter "the Remnant), being a <br />portion of Tax Map Key No. (3) 2-2-037:999 with an approximate area of 6,180 square feet or <br />0.142 acres, and situated at Waiakea, District of South Hilo, Island, County, and State of <br />Hawaii, as depicted on "Exhibit A" and more particularly described in "Exhibit B", both of <br />which are attached hereto and made a part hereof; and <br />WHEREAS, the Remnant is a segment of Leilani Street abutting land owned by the <br />State, identified as Tax Map Key No. (3) 2-1-012:004 (hereinafter "the State Parcel"); and <br />WHEREAS, the Remnant is not used by the public because it is currently used as the <br />main driveway to the State Parcel; and <br />WHEREAS, the County wishes to dispose of the Remnant and convey it to the State, <br />thereby alleviating the County of any liability or maintenance responsibility; and <br />WHEREAS, the State is willing to accept conveyance of the Remnant for the purpose of <br />consolidating it with the State Parcel; and <br />WHEREAS, in exchange for the conveyance of the Remnant, the State has agreed to <br />expand the area of public lands set aside for use by the County Department of Parks and <br />Recreation under Executive Order Nos. 2283 and 3825, identified as Tax Map Key No. (3) 2-1- <br />012:005, from 2.819 acres to 5.684 acres, as approved by the State's Board of Land and Natural <br />Resources on November 11, 2022; and <br />WHEREAS, Section 2-120 of the Hawaii County Code 1983 (2016 Edition, as <br />amended) requires the approval of a resolution to direct the disposal, lease, sale, exchange, grant, <br />or other conveyance real property owned by the County to other governmental agencies; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAYI that, in <br />accordance with Section 2-120 of the Code, the disposition and conveyance of the Remnant to <br />
