MSY os ti <br />COUNTY OF HAWAI`I STATE OF HAWAI`I <br />RESOLUTION NO. <br />527 26 <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />INTERGOVERNMENTAL AGREEMENT WITH THE UNIVERSITY OF HAWAVI, <br />BIG ISLAND INVASIVE SPECIES COMMITTEE, FOR THE PURPOSE OF <br />AWARDING GRANT FUNDS TO CONTROL AND COMBAT THE SPREAD OF <br />INVASIVE SPECIES. <br />WHEREAS, Section 46-7 of the Hawaii Revised Statutes requires the consent of the <br />Council in order for the County to enter into an agreement with the federal government or any <br />other public body respecting action to be taken pursuant to any of the powers granted to the <br />County by law and furnish, expend, and receive any funds or other assistance in connection with <br />projects being or to be undertaken pursuant to those powers; and <br />WHEREAS, Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii County Code <br />1993 (2016 Edition, as amended) (hereinafter "the Code") provides that grants awarded "in <br />excess of $25,000 to nonprofit organizations shall specifically identify the organization receiving <br />the grant funds and the purpose for which the grant funds shall be used in a resolution"; and <br />WHEREAS, Chapter 2, Article 25, Section 2-136 of the Code defines a "nonprofit <br />organization" as "an organization that is registered and in good standing in the State of Hawaii <br />as a nonprofit organization and maintains a 501(c)(3) charitable designation from the Internal <br />Revenue Service"; and <br />WHEREAS, Section 2-138 of the Code provides, in part, that the County may only grant <br />an award when "[t]he program or service proposed in the grant application yields direct benefits <br />to the public and accomplishes public purposes within the County"; and <br />WHEREAS, the Department of Research and Development (hereinafter "R&D") wishes to <br />award a total of $250,000 to the University of Hawaii, Big Island Invasive Species Committee <br />(hereinafter "BIISC"); and <br />WHEREAS, BIISC is a nonprofit organization, as defined hereinabove; and <br />WHEREAS, BIISC possesses the capacity and the technical understanding that the <br />County currently lacks to administer educational outreach and implement the control and <br />management of the many invasive species plaguing the community; and <br />WHEREAS, grant monies will be used to fund: <br />1. Detection and control of the Devil Weed in ten sites throughout Hilo and Puna; <br />2. Onsite training and support to farmers and residents dealing with infestations of the <br />Queensland Longhorn Beetle; <br />3. Early detection and community outreach efforts in response to the presence of the <br />Coconut Rhinoceros Beetle in Kona; <br />
