COUNTY OF HAWAPI STATE OF HAWAI`I <br />RESOLUTION NO. 524 26 <br />A RESOLUTION ACCEPTING A DONATION OF AN INDUSTRIAL DISHWASHER <br />AND DISH COLLECTION BIN FOR THE HO`I RETURNABLE DISH PROGRAM TO <br />BE USED BY THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT. <br />WHEREAS, Article JHII, Section 13-12, of the Charter of the County of Hawaii <br />(hereinafter "the Charter") provides that the Council, "on behalf of the county, may accept gifts <br />of donations of money, securities or other personal property or of real estate or any interest in <br />real estate"; and <br />WHEREAS, Chapter 2, Article 30, Section 2-162(a), of the Hawaii County Code 1983 <br />(2016 Edition, as amended) (hereinafter "the Code") provides, in part, that "gifts or donations of <br />money, securities, or personal property which fall within the capitalization procedures of the <br />department of finance may be accepted by resolution approved by the council"; and <br />WHEREAS, Perpetual Use Inc., a non-profit entity, (hereinafter, "Perpetual") wishes to <br />donate an industrial dishwasher with an estimated value of $245,000 and a dish collection bin <br />with an estimated value of $3,571 to the Department of Environmental Management (hereinafter, <br />"DEM"); and <br />WHEREAS, this dishwasher and dish collection bin are intended to be used for the Ho`i <br />Returnable Dish Program, a community -wide reuseable foodware program designed and <br />implemented by DEM, Perpetual, Zero Waste Hawaii Island, and the University of Hawaii Sea <br />Grant Program; and <br />WHEREAS, in 2024, the United States Environmental Protection Agency (hereinafter, <br />"EPA") awarded the County $1,522,130 in grant funding through the Solid Waste Infrastructure <br />for Recycling grant program (hereinafter, "SWIFR') to support program infrastructure; and <br />
