COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. ~:I 0~; <br /> RESOLUTION AUTHORIZING THE ABANDONMENT AND QUITCLAIM OF REMNANT AT PIRA <br /> HOMESTEADS, NORTH HILO, HAWAII TO VALERIE DE FRAIN, TAX MAP KEY NO. (3) 3-2-02: <br /> PAPER ROADS <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> WHEREAS, the County of Hawaii, Department of Finance has reached an agreement with <br /> Valerie De Frain for the transfer of a paper road remnant as identified on the map attached as Exhibit <br /> "A," which has a land area of approximately 0.077 acre, and was appraised at a value of $500.00; <br /> and <br /> WHEREAS, this road remnant is part of the ongoing dispute over these roads in limbo <br /> between the State and County; and <br /> WHEREAS, since the County has assumed greater responsibility with respect to these roads <br /> in limbo, the County and State have both agreed that the County should be the body to transfer these <br /> roads to Valerie De Frain, and that as such should receive the proceeds from the transfer from this <br /> road remnant; and <br /> WHEREAS, this road is a paper road traversing through Valerie De Frain's property which <br /> does not actually appear on the ground; and <br /> WHEREAS, an appraisal was done of the property in 2002 which established a fair market <br /> value of $500.00; and <br /> WHEREAS, it would be in the best interest of the County and Valerie De Frain that the paper <br /> road be abandoned and quitclaimed to Valerie De Frain; and <br /> WHEREAS, upon quitclaim of the property by the County of Hawaii, Department of Finance, <br /> <br /> the sum of $500.00 will be tendered by Valerie De Frain; and <br /> WHEREAS, Sections 2-111 and 2-118 of the Hawaii County Code authorizes the disposal of <br /> road remnants by offer of sale to the abutting owner. <br /> <br />
