COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. 183 <br /> (Draft 3) <br /> ORDINANCE NO. 04 4 <br /> A BILL FOR AN ORDINANCE AMENDING CHAPTER 2 OF THE HAWAFI COUNTY CODE 1983 <br /> (1995 EDITION), ADMINISTRATION, RELATING TO THE ESTABLISHMENT' OF A DISASTER <br /> AND EMERGENCY FUND. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Purpose. The County Counci] finds that there is a need to create a special fund to <br /> provide immediate response to repair county facilities and infrastructure due to damages caused by a natural <br /> or man-made disaster or other emergencies, and to clean up property when such action serves a public <br /> purpose. <br /> SECTION 2. Chapter 2 of the Hawaii County Code, 1983 (1995 Edition), relating to <br /> <br /> Administration, is hereby amended, by the addition of a new article to read as follows: <br /> "ARTICLE DISASTER AND EMERGENCY FUND. <br /> Section 2-_. Creation of Fund. <br /> Pursuant to section 10-12, Hawai' i County Charter, a special fund to be known as the <br /> Disaster and Emergency Fund is created. <br /> Section 2-_. Funding. <br /> The Disaster and Emergency Fund shall be funded each fiscal year by the council appropriating a <br /> minimum of $100,000 to a maximum of $1,000,000 per year until the Fund has accumulated a <br /> maximum of $5,000,000. <br /> Section 2-^. Expenditures from the Disaster and Emergency Fund. <br /> The moneys in the Disaster and Emergency fund shall be only utilized for the following <br /> purposes: <br /> (a) 1'o repair county facilities and infrastructure damaged by a natural or man-caused <br /> disaster or emergency. <br /> (b) To clean up property, including roads and sewage systems, damaged by a natural or <br /> man-caused disaster or other emergencies when such action serves a public purpose. <br /> (c) 'Io provide immediate response for services to deal with public health and safety risks <br /> due to a natural orman-caused disaster or emergency in the form of personnel, <br /> equipment, materials, supplies, and service contracts. <br /> (d) "I'o match federal, state, and/or private grants-in-aid to develop or restore public property <br /> to a safe and useable condition. <br /> (e) To pay for administrative expenses, which shall not exceed five percent (5%) of this <br /> Fund. <br /> <br />
