Kiriu~~,~~ <br /> Legislative Auditor <br /> RE: Bi11280 relating to Business Improvement District <br /> This is in response to questions raised at the June 14`" meeting of the Committee on Finance <br /> relating to Bill No. 280, Business Improvement District (BID) <br /> L Why was Bill No. 280 written to add a new chapter to the Hawaii County Code rather than <br /> expanding an existing chapter of the Code, such as Chapter 12 (Improvement District)? <br /> The purpose and mechanics behind establishing a business improvement district (BID) <br /> pursuant to §46-80.5, Hawaii Revised Statutes, are distinct from the improvement district and <br /> community facilities district statutes (§§46-80 and 46-80.1, HRS). Rather than adding a new <br /> article or division to existing code chapters, we determined that a new chapter would be <br /> consistent with the creation of separate Chapters 12 and 32 (Improvement District (ID) and <br /> Community Facilities Districts (CFD), respectively). <br /> 2. What is the difference between the Business Improvement District concept and the other <br /> fanancing tools in the Code? <br /> Purpose. The purpose of the BID is to provide and finance supplemental maintenance and <br /> security services and other improvements, services, and facilities that will restore or promote <br /> business activity in the district. The ID and the CFD fund facilities and improvements. <br /> District management or implementation. The BID allows the County to provide for a <br /> board or association to manage and to carry out the activities of the business improvement <br /> district.
