H9-54, WHICH RECLASSIFIED 2.23 ACRES OF LAND FROM A MULTIPLE FAMILY <br /> RESIDENTIAL 1,000 SQUARE FOOT (RM-I) TO A RF.SOR'F-HOTEL 1,000 SQUARE, <br /> FOOT (V-I) DISTRICT AT PUAA 2ND, NORTH KONA, HAWAI`[, COVERED BY TAX <br /> MAP KEY 7-5 x):40. <br /> BE I'f ORDAINED BY TfiE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Ordinance No. 91 71 is amended as follows: <br /> "SF,C'LION 2. This change in district classification is conditioned upon the following: <br /> (A) The applicant, successors or assigns shall be responsible for complying with all <br /> stated conditions of approval; <br /> (B) Special Management Area (SMA) Use Permit application for the proposed <br /> development shall be Fled with the Planning Department within one year from <br /> the effective date of this new amendment[;] Final Ian a royal shall be <br /> obtained within three years from the effective date of this ordinance. <br /> (C) A drainage system shall be installed in accordance with the requirements of the <br /> Department of Public Works; <br /> Access to Alii Drive/Walua Road and Kuakini Hi~hwav including the provision <br /> of sight distances and the followine movement restrictions, shall meet with the <br /> approval of the Department of Public Works. I . Movements allowed at the <br /> Kuakini Highway approach may be limited to rieht into and ri fif tout of the <br /> sub ect property when future Kuakini Hiahway improvements are made. <br /> 2 Movement restrictions along Alii Drive/Walua Road shall be determined <br /> when final t*.eomctrics are submitted prior to receipt of Final Plan Approval. <br /> <br />
