Nawa~'i 967!3 <br /> May 25, 2007 ` <br /> TO: Council Members <br /> Hawaii County Council <br /> FROM: ~ Pete Hoffmann <br /> Council Chairperson <br /> SUB.IECT: Transmitting a proposed amendment to Bill 51, Draft 3 <br /> An Ordinance Amending Chapter 27, Flood Control, Hawaii County Code'1983 <br /> (2005 Edition), as amended, Relating to Stormwater Management <br /> Attached for your consideration is a proposed amendment to Bill 51, Draft 3, relating to Flood <br /> Control, which amends Chapter 27, article 4, section 27-18(c)(6). This subsection imposes new <br /> regulations in areas where the natural grade of the ground surface exceeds ten percent, in order to <br /> adequately mitigate potential flood hazards resulting from man-made alteration of the terrain in <br /> such areas. Because of the length of the bill, I am not attaching the entire bill, but only an excerpt <br /> from the affected section. <br /> "the proposed amendment addresses concerns raised during public testimony at the May 15, 2007 <br /> Public Works and Intergovernmental Relations Committee meeting. The proposed new language <br /> clarifies that landscaping, agriculture, and other activities which do not result in the creation of <br /> impermeable surfaces on the site are permitted, with the certification of a professional civil <br /> engineer. The proposed amendment allows adequate land area of smaller lots to be developed <br /> with impermeable surfaces, by increasing the percentage from twenty percent to forty percent of <br /> the total land area. The proposed amendment permits up to forty percent of the site to be <br /> developed with impermeable surfaces, with the certification of a professional civil engineer. <br /> Chapter 27, article 4, section 27-18, Hawaii County Code 1983 (2005 edition), is amended by <br /> adding a new subsection (c)(6) to read as follows: <br /> "(6) Within areas where the grade of the natural elevation of the around surface prior <br /> to construction exceeds ten percent, fi11inQ, erading, and other development <br /> which may increase flooding or erosion hazards shall be prohibited unless a <br /> professional civil engineer licensed in the State of Hawaii certifies that the <br /> Comm.
