Director of the Ucpartment of Finance. transmitting Resolution ~o. 90-03 tier Council consideration. the purpose of Kesolution Su. 90-0 ~ is to authorize the abandonment and sale of a portion of the Alcnaio Street right-of-~~u~ to Ballard Mortuar}'. According to Resolution No. 90-03, a building located on l'MK (3) ?-3-018:53. which is owned by Ballard Morhiarv. encroaches onto Alcnaio Street right-ol=way. Specificalh. the portion is identified as the -1lenaio Lane stub out. ~I~hc resolution states that the County of I lawai'i no longer needs this stub out because it is unsuitable for future utilization or de~clopmem and, thercl~irc, i~ should be declared a remnant and sold. I~:,~hibit A. a map detailing the ahovc parcel. is also attached to Resolution No. 9U-Q3. 1t today's meeting, Gerald Fakasc, Assistant Corporation Counsel and Daryn Arai of the Planning Department provided the committee w ith a brief commentary about the need, purpose and particulars of Resolution No. 90-U3. Ms..leri Hall, Carlsmith Ball, attorney for Ballard 'Mortuary, also participated in discussion intermittently. Your committee has requested the Ibllowing Rom the Office of the Corporation Counsel before the nett scheduled Council meeting: Documentation demonstrating that both the Public Works and Planning DeparUnents concur with this action as stated within Resolution 9U-U>. Z. Continuation of the clussilication and title of the right-ol=way to he sold. Specilically_ whether the right-of=way should be referred to as "Alcnaio Su~ecf~ or °Alcnaio Lance in the resolution. ~. Requests that Ballard 'Mortuary cover incidental costs of this action. -4.
