COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. X763 08 <br />A RESOLUTION REQUESTING THAT THE ADMINISTRATION ATTEMPT TO <br />INCREASE PUBLIC AWARENESS REGARDING THEIR PROPOSED AMENDMENT <br />TO CHAPTER 10 OF THE HAWAII COUNTY CODE RELATING TO EROSION AND <br />SEDIMENTATION CONTROL BY HOLDING COMMUNITY MEETINGS IN THE SIX <br />MOKU LAND DIVISIONS OF HAWAII ISLAND. <br />WHEREAS, flooding can be a natural occurrence from rainfall, but flooding events can <br />be increased in quantity and magnitude by poor land use decisions, inappropriate grubbing, pin- <br />to-pin grading, removal of rain and cloud forest, diversion of water courses, and blockage of <br />water courses with debris; and <br />WHEREAS, the administration of Hawaii County has drafted and presented to the <br />Hawaii County Council a potential amendment to chapter 10 of the Hawaii County Code; and <br />WHEREAS, the Department of Public Works committed more than nine months ago to <br />hold public meetings for public input and has been under a court order to amend chapter 10 for <br />more than three years; and <br />WHEREAS, the Department of Public Works has failed to hold a single public meeting <br />on chapter 10, yet the Department of Public Works submitted an amendment to chapter ] 0; and <br />WHEREAS, multiple severe flooding events have occurred due to watercourse diversion <br />and/or blockage, development, and lack of enforcement of existing sections of chapter 10; now; <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that <br />before the County Council considers the administration's amendment of chapter 10, the <br />Department of Public Works shall hold public meetings in the moku of Hilo, Puna, Ka`u, Kona, <br />Kohala, and Hamakua to obtain public input on community concerns regarding erosion, <br />sedimentation, flooding, and the administration's proposed amendments to chapter 10. <br />
