COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. ~.6$ 09 <br />RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DONATION <br />OF TWO (2) SEAGRAVE FIRE PUMPERS FROM THE COUNTY OF <br />MAUI, AND TO ENTER INTO A RELEASE, HOLD HARMLESS AND <br />INDEMNITY AGREEMENT FOR ANY LIABILITY RESULTING FROM <br />THE TRANSFER OF OWNERSHIP AND CONTROL OF THESE <br />VEHICLES, AS A CONDITION OF THE DONATION TO THE COUNTY <br />OF HAWAII FIRE DEPARTMENT <br />WHEREAS, the County of Maui, Department of Fire and Public Safety ("Maui Fire <br />Department") recognizes the need for additional emergency fire vehicles in order to meet the <br />growing needs here in the County of Hawaii and wishes to assist the County of Hawaii Fire <br />Department ("HFD") in providing such vehicles to meet those needs; and <br />WHEREAS, the donation consists of two (2) fire trucks, Vehicle Identification Numbers <br />Z-78350 1F9EW28JOMCST2148 and Z-78351 1F9EW28J8MCST2155, manufactured and <br />originally purchased by the County of Maui in 1991, each with a current valuation of $50,000 <br />apiece; and <br />WHEREAS, both fire trucks aze Seagrave Model JBSODH 1500 GPM Fire Pumpers <br />with miscellaneous equipment; and <br />WHEREAS, the Maui Fire Department no longer requires the service of these vehicles, <br />as either frontline or relief appazatus, because they have purchased newer models; and <br />WHEREAS, HFD intends to add both vehicles to its reserve fleet, which is utilized in the <br />event of frontline vehicle breakdowns, and currently many of the vehicles in HFD's reserve fleet are <br />of earlier vintage than both the proposed additions; and <br />WHEREAS, as a municipal corporation, considering the age of the vehicles, it is to be <br />expected that the County of Maui would want full immunity and indemnification for its proposed <br />donation; and <br />WHEREAS, HFD's Chief Mechanic and Auxiliary Services Battalion Chief traveled to <br />Maui to inspect both vehicles and found them to be mechanically sound and well-maintained, not <br />requiring any immediate costs to bring them up to HFD standards; and <br />WHEREAS, upon the advice of the County of Hawaii Office of the Corporation <br />Counsel, a written statement has been obtained from the County of Maui regarding any post- <br />manufactured modifications made to both vehicles, of which there were none; and <br />WHEREAS, the HFD recommends the acceptance of this donation; and <br />
