COUNTY OF HAWAII <br />~ohsr os yew'' <br />;`, ylnlq. <br />STATE OF HAWAII <br />..J __ _', <br />RESOLUTION NO. <br />228 09 <br />RESOLUTION ACCEPTING THE DEDICATION OF PARK SITE, BEING TAX MAP <br />KEY: (3)2-7-040:010, SITUATE AT PAUKA`A, DISTRICT OF SOUTH HILO, COUNTY AND <br />STATE OF HAWAII, FROM HILO ONE, INCORPORATED. <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br />WHEREAS, Hilo One, Incorporated is the owner of a parcel in the Honoli`i Place Subdivision, <br />containing an area 2.003 acres, identified as Tax Map Key: (3)2-7-040:010, situate at Pauka`a, in the <br />District of South Hilo, County and State of Hawaii, described in Exhibit "A" and delineated on <br />Exhibit "B" attached hereto; and <br />WHEREAS, Hilo One, Incorporated is desirous of dedicating the subject parcel, including all <br />improvements thereon, to the County of Hawaii for park purposes, in compliance with Condition I of <br />Ordinance No. 96-121, and the improvements have been inspected and approved by the County of <br />Hawaii Planning Department and the Department of Parks and Recreation; and <br />WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br />council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br />HAWAI`1, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the County <br />of Hawaii accepts the parcel in the Honoli`i Place Subdivision, containing an area 2.003 acres, <br />identified as Tax Map Key: (3)2-7-040:010, including all improvements thereon, for park purposes. <br />BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor <br />William P. Kenoi; (2) the Department of Parks and Recreation; (3) Deputy Corporation Counsel <br />
