JNIY.OF N,W... <br /> COUNTY OF HAWAII < / - _ I <br /> STATE OF HAWAII <br /> BILL NO. 97 <br /> ORDINANCE NO. /a 90 <br /> AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 11, DIVISION 1, SECTION 24- <br /> 302 OF TIIE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), <br /> RELATING TO THIRTY-FIVE MILE PER HOUR SPEED LIMIT ON PRIVATE <br /> STREETS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. The purpose of this measure is to establish speed limits in the Hawaii <br /> County Code for the Hawaiian Paradise Park Subdivision so that speed limits can he properly <br /> enforced by the police. Pursuant to Section 24-2 of the Hawai`i County Code, the County shall <br /> not be responsible for the maintenance and repair of any private street, highway, or thoroughfare <br /> when it imposes or enforces traffic regulations and highway safety laws on that private street, <br /> highway, or thoroughfare. <br /> SECTION 2. Chapter 24, article 11, division 1, section 24-302, schedule 6 (Reserved), <br /> of the Hawaii County Code 1983 (2005 Edition. as amended), is amended to read as follows: <br /> "Section 24-302. Schedule 6. [Reserved] 35 mile per hour limit. <br /> A speed limit of thirty-five miles per hour is established as set forth in this schedule upon <br /> the private streets or portions of private streets as follows: <br /> (a) Hamakua <br /> (b) North Hilo <br /> fc) South Milo <br /> (d) Ka'u <br /> O Kohala <br /> (f) Kona <br /> (g) Puna <br /> ( ) Hawaiian Paradise Park Subdivision, Shower Drive, Kaloli Drive, Paradise Drive <br /> and Maku`u Drive." <br />
