Mi M�i'r <br /> RESOLUTION NO. 237 13 <br /> RESOLUTION ACCEPTING THE DEDICATION OF MA'A WAY (ROAD LOT A), BEING <br /> A PORTION OF TAX MAP KEYS: (3) 7-4-010:013, 014 AND (3) 7-4-025:005, SITUATED ON <br /> THE EASTERLY SIDE OF LOLOKU STREET AND ON THE WESTERLY SIDE OF KAIWI <br /> STREET AT KEAHUOLU, DISTRICT OF NORTH KONA, ISLAND AND COUNTY AND <br /> STATE OF HAWAII FROM TRUSTEES OF THE QUEEN LILI`UOKALANI TRUST. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I. <br /> WHEREAS, Trustees of the Queen Lili`uokalani Trust are the owners of Ma'a Way (Road <br /> Lot A), containing an area of 32,811 square feet, identified as a portion of Tax Map Keys: (3) 7-4- <br /> 010:013, 014 and (3) 7-4-025:005,situated at Keahuolu, District of North Kona, Island and County <br /> and State of Hawai`i, as delineated on Exhibit"A" attached; and <br /> WHEREAS, Trustees of the Queen Lili`uokalani Trust have constructed all subdivision <br /> improvements and received final subdivision approval for the above referenced lot; and <br /> WHEREAS, Trustees of the Queen Lili`uokalani Trust are desirous of dedicating the above <br /> roadway lot, including all subdivision improvements thereon, to the County of Hawai`i for roadway <br /> purposes, and the improvements have been inspected and approved by the County of Hawai`i <br /> Department of Public Works, and received dedication approval from the Department of Water Supply, <br /> Planning Department and Department of Environmental Management; and <br /> WHEREAS, Section 23-10 of the Hawai`i County Code prohibits the Council from receiving <br /> by dedication any streets in any subdivision platted after December 2, 1966 except upon full <br /> compliance with the provisions of Chapter 23; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the <br /> council may accept gifts, which include the dedication of land, on behalf of the County of Hawai`i. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds <br /> the subject subdivision and improvements thereon are in full compliance with the provisions of <br /> Chapter 23 of the Hawai`i County Code as certified and approved by all applicable agencies. <br />
