+troF M?!t7 <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> 7TE Oi•M/i, <br /> RESOLUTION NO. 423 14 <br /> A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO ENTER INTO <br /> NEGOTIATIONS FOR THE ACQUISITION OF TAX MAP KEY NOS. (3) 7-7-008:021 <br /> AND 023, WHITE SANDS MAUKA IN THE AHUPUA`A OF PAHOEHOE IN THE <br /> DISTRICT OF NORTH KONA, PURSUANT TO CHAPTER 2, ARTICLE 42 OF THE <br /> HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED). <br /> WHEREAS, Chapter 2, Article 42 of the Hawaii County Code 1983 (2005 Edition, as <br /> amended) (hereinafter "the Code"), established the Public Access, Open Space, and Natural <br /> Resources Preservation Fund; and <br /> WHEREAS, Section 2-215 of the Code established the Public Access, Open Space, and <br /> Natural Resources Preservation Commission (hereinafter"the Commission"); and <br /> WHEREAS, Section 2-217 of the Code provides, in pertinent part, that the <br /> Commission's first duty and responsibility is, "To develop and submit to the mayor, an initial <br /> island-wide prioritized list of qualifying lands worthy of preservation..."; and <br /> WHEREAS, the Commission cited the purchase of White Sands Mauka as a key priority <br /> and ranked it number ten in its 2013 Annual Report to the Mayor, dated December 27, 2013; and <br /> WHEREAS, White Sands Mauka, covered by Tax Map Key Nos. (3) 7-7-008:021 and <br /> 023, offers a unique opportunity for public outdoor recreation and education, serving what <br /> continues to be one of the most densely populated areas on Hawaii Island; and <br /> WHEREAS, the acquisition of this property will expand Kipapa Park, which was <br /> recently acquired by the County of Hawaii, turning it into a combined 16.8-acre recreation area <br /> suitable for walking, biking,jogging, picnicking, and parking; and <br /> WHEREAS, the property, which is zoned RM-3.5, has been approved for a 120-unit <br /> condominium and runs from Ali`i Drive to the proposed Ali`i Parkway right-of-way; and <br /> WHEREAS, a County-required Special Management Area Use Permit and an <br /> archaeological survey conducted by Haun & Associates in 2005 clearly identified and <br /> documented significant burial and cultural sites; and <br /> WHEREAS, Chapter 6, Section 6.3(d) of the Hawaii County General Plan (February <br /> 2005 Edition, as amended) states, "Public access to significant historic sites and objects shall be <br /> acquired, where appropriate."; and <br />
