Curtis Tyler, III, Councilmember
Hawaii County Council
RE: University Heights West Project
Pursuant to our January 31 meeting in your office regarding the
referenced project, I would like some clarification of the
department's position on the pre-emptions being proposed by
under HRS 201E-210.
~.~+T¢ lt+a,
i 9 ¢il
The Council is being asked to approve three pre-emptions from
the zoning and subdivision codes for the proposed project. As
part of my evaluation of the effect such pre-emptions might
have on residents and the general public, i need to know the
following:
1. Has your department reviewed the proposed
pre-emptions?
2. If so, what effects will these pre-emptions have on
the department's existing standards for any improvements
normally required for a development of this size?
3. if any standards will be changed by these
pre-emptions, what effect will such changes have on the issues
of public health, safety, and welfare?
4. Will the County (i.e. taxpayers) be exposed to any
additional liability if any or all of these are approved?
5. If so, will your department be willing to endorse
these pre-emptions inspite of these?
cow.. t,r0. ~ZL.OG
Blle xa. H SG
8ef 201 P?MSenfed c ti < ~ ~
Bef.
