J�tY OF M,�1 <br /> COUNTY OF HAWAII -•� �'"-'�1 STATE OF HAWAII <br /> • • art os'M►'� . <br /> RESOLUTION NO. 321 15 <br /> RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOTS 110, 111 AND 509, <br /> BEING A PORTION OF TAX MAP KEY NOS.: (3) 7-3-060:051 (POR) AND (3) 7-3-061:053, <br /> SITUATE AT KALAOA 5TH, DISTRICT OF NORTH KONA, ISLAND OF HAWAII, STATE <br /> OF HAWAII, FROM TRI INDEX HOLDINGS, INC., A HAWAII CORPORATION. <br /> WHEREAS, Tri Index Holdings, Inc., a Hawaii corporation, is the owner of Road Lots 110, <br /> 111 and 509, portions of which contains an area of 108,611 square feet, 26,373 square feet, and <br /> 53,189 square feet, more or less, respectively, identified as a portion of Tax Map Key Nos.: (3) 7-3- <br /> 060:051 (por.) and (3) 7-3-061:053, situate at Kalaoa 5th, District of North Kona, Island of Hawai`i, <br /> State of Hawai`i, as delineated on Exhibit "A" attached; and <br /> WHEREAS, Condition G, Rezoning Ordinance No. 98-66 required the main access road and <br /> interior subdivision roads to be dedicated to the County of Hawai`i; and <br /> WHEREAS, Tri Index Holdings, Inc., a Hawai`i corporation, has constructed all subdivision <br /> improvements and received final subdivision approval; and <br /> WHEREAS, Tri Index Holdings, Inc., a Hawai`i corporation, is desirous of dedicating the <br /> above roadway lots, including all subdivision improvements thereon, to the County of Hawai`i for <br /> roadway purposes, and the improvements have been inspected and approved by the County of Hawai`i <br /> Department of Public Works, and received dedication approval from the Department of Water Supply, <br /> Planning Department and Department of Environmental Management; and <br /> WHEREAS, Section 23-10 of the Hawai`i County Code prohibits the Council from receiving <br /> by dedication any streets in any subdivision platted after December 2, 1966 except upon full <br /> compliance with the provisions of Chapter 23; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the <br /> council may accept gifts, which include the dedication of land, on behalf of the County of Hawai`i. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds <br /> the subject subdivision and improvements thereon are in full compliance with the provisions of <br /> Chapter 23 of the Hawai`i County Code as certified and approved by all applicable agencies,and that it <br /> is in the public interest to accept such dedication. <br />
