,'J+SY OS N,.... <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> • �OFN►� , <br /> RESOLUTION NO. 707 16 <br /> A RESOLUTION URGING THE 2017 HAWAII STATE LEGISLATURE TO PREVENT <br /> ANIMAL CRUELTY BY PROHIBITING THE UNSAFE TETHERING OF DOGS. <br /> WHEREAS, the improper use of tethers on dogs can cause deficiencies in meeting the <br /> physical and behavioral needs of dogs and lead to injury or death. Tethers can become tangled <br /> or caught resulting in a risk of strangulation. They are sometimes very heavy or short, or both, <br /> limiting a dog's mobility to a small area that also may be the site of the dog's own waste; and <br /> WHEREAS, there continue to be reports of improper tethering by dog owners in this <br /> state; and <br /> WHEREAS, the Council believes, that to ensure that dog owners care for their dogs in a <br /> safe and humane manner using best practices in the tethering of their dogs, current state law on <br /> this subject, found in paragraph 711-1109(1)(g), Hawaii Revised Statutes, should be amended to <br /> read (material to be added is underscored, material to be repealed is bracketed and stricken): <br /> "(1) A person commits the offense of cruelty to animals in the second degree if the <br /> person intentionally, knowingly, or recklessly: , , , <br /> (g) Tethers, fastens, ties, or restrains a dog to a doghouse, tree, fence, or <br /> any other stationary object [by-means]: <br /> (i) By means of a choke collar, pinch collar, or prong collar; <br /> provided that a person is not prohibited from using such <br /> restraints when walking a dog with a hand-held leash or while a <br /> dog is engaged in a supervised activity; [or] <br /> (ii) In a configuration that: <br /> (A) Entangles and endangers a dog; <br /> (B) Limits a dog's movement in an unsafe or unsanitary <br /> condition; or <br /> (C) Causes injury to a dog; or <br /> (iii) By use of a restraint that is shorter than three times the length of <br /> the dog, as measured from the tip of the dog's nose to the base of <br /> the dog's tail, or five feet, whichever is greater; or. . . ," <br /> ; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> members of the Hawaii State Senate and the Hawai`i State House of Representatives are <br /> encouraged to introduce legislation to amend section 711-1109 as provided herein. <br />
