COUNTY OF HAWAII .r ,: / * STATE OF HAWAI'I <br /> 6.1%, <br /> '•�tE•OF•N�'�-• <br /> BILL NO. 10 <br /> ORDINANCE NO. 17 24 <br /> AN ORDINANCE AMENDING ORDINANCE NO. 12 111 WHICH AMENDED <br /> ORDINANCE NO. 99 116 WHICH AMENDED ORDINANCE NO. 96 159 WHICH <br /> AMENDED SECTION 25-8-33 (CITY OF HILO ZONE MAP), ARTICLE 8, CHAPTER 25 <br /> (ZONING CODE) OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS <br /> AMENDED) (formerly referred to as Section 25-114, City of Hilo Zone Map, Article 3, Chapter <br /> 25, Zoning Code), BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE <br /> FAMILY RESIDENTIAL— 10,000 SQUARE FEET (RS-10) TO NEIGHBORHOOD <br /> COMMERCIAL—7,500 SQUARE FEET (CN-7.5) AT WAIAKEA, SOUTH HILO, HAWAII, <br /> COVERED BY TAX MAP KEY: 2-2-044:003, 031, 032, 035, AND 037. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Ordinance No. 12 111 is amended as follow: <br /> "SECTION 2. The following amendments to Ordinance No. [99 116] 12 111 shall apply <br /> only to Tax Map Key Nos. 2-2-044:031, 032, 035 and 037. In accordance with Section 25-2-44, <br /> Hawai`i County Code 1983 (2016 Edition, as amended) the County Council finds the following <br /> conditions are: <br /> prevent circumstances which maybe adverse to the public <br /> (1) Necessary to <br /> health, safety and welfare; or <br /> (2) Reasonably conceived to fulfill needs directly emanating from the land use <br /> proposed with respect to: <br /> (A) Protection of the public from the potentially deleterious effects of <br /> the proposed use, or <br /> (B) Fulfillment of the need for public service demands created by the <br /> proposed use. <br /> -1- . <br />
