JNty Of j"q <br />COUNTY OF HAWAIII �STATE OF HAWAII <br />?t' 0'.�' <br />RESOLUTION NO. 51-9 J-8 <br />RESOLUTION ACCEPTING PAYMENT OF IN -LIEU FEE IN THE AMOUNT OF <br />$23,600 BY WAINANI 42 LLC, TO PARTIALLY SATISFY CONDITION "L" OF <br />ORDINANCE NO. 98-66. <br />WHEREAS, on June 19, 2001, the Hawaii. County Housing Agency passed Resolution <br />No. 123 approving payment of in -lieu fees totaling $94,400 to satisfy condition "L" of Ordinance <br />98-66 for the development of up to 200 units at Puapua`a 1St and 2nd, North Kona, Hawai'i, <br />covered by tax map key (3) 7-3-010:027; and <br />WHEREAS, in accordance with Housing Agency Resolution No. 123, Wainani 42 LLC <br />paid $23,128 in -lieu fee on January 22, 2007 for forty-nine (49) units in Phase I; and <br />WHEREAS, on July 10, 2015, Wainani 42 LLC paid $23,600 in -lieu fee to partially <br />satisfy the affordable housing requirement for fifty (50) units in Phase II; and <br />WHEREAS, if the remaining (9 1) units are developed, the developer shall pay an <br />additional $47,672 in in -lieu fees to satisfy Condition "L" of Ordinance 98-66; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that <br />pursuant to the Housing Agency Resolution No. 123, the County Council does hereby accept <br />payment of $23,600 by Wainani 42 LLC, to satisfy Condition (L) of Ordinance No. 98-66 for <br />Phase II of the development of the fifty (50) units. <br />BE IT FURTHER RESOLVED, that this resolution shall take effect immediately upon <br />approval. <br />
