<br />PLANNING COMMISSION <br />COUNTY OF HAWAI€I <br />HEARING TRANSCRIPT <br />SEPTEMBER 2, 2005 <br />A regularly advertised hearing on the application of JAN MALASEK (GEOTHERMAL ASSET <br />FUND CLAIM)was called to order at 9:20 a.m. and again at 10:10 a.m. in the County Building, <br /> <br />Councilroom - Room 201, 25 Aupuni Street, Hilo, Hawai€i, with Chairman Fred Galdones <br />presiding: <br />PRESENT:Fred Galdones ABSENT & EXCUSED: William Graham <br />C. Kimo AlamedaJeffrey McCall <br />Andrew Iwashita Rodney Watanabe <br />AllenSalavea <br />Hannah Springer ABSTENTION: Rene Siracusa <br />Ivan Torigoe, Deputy Corporation Counsel <br />Christopher Yuen, Planning Director <br />Norman Hayashi, Planning Program Manager <br />Phyllis Fujimoto, Staff Planner <br />Jeff Darrow, Staff Planner <br />And one person from the public in attendance. <br /> <br />CLAIMANT: JAN MALASEK <br />Geothermal Asset Fund Claim in the amount of $27,494.00 to compensate for a loss of income <br />from a orchard and nursery operation due to geothermal activity in the area. The property is <br />located at 13-683 Leilani Avenue, approximately 1600 feet south of the Leilani Avenue „ <br />Pohoiki Road intersection, Leilani Estates Subdivision, Keahialaka, Puna, Hawai€i, TMK: 1-3- <br />28:18. <br />GALDONES:Commissioners, on Agenda Item No. 1, Unfinished Business, Claimant is <br />Jan Malasek. Unfortunately, Mr. Malasek is not here. He has been informed of todays meeting <br />however. And being that he is not here present, wed still like to give him an opportunity to be <br />able to make a presentation in case something has detained him that we are not aware of. So my <br />recommendation is to address that subject matter, take it out of order, and lets take that after <br />Agenda Item No. 4; and if he is still not here then at that time we shall decide how we will <br />proceed in his absence. <br />At 9:22 a.m., the Commission proceeded with taking up the remaining agenda items. <br />At 10:20 a.m., the Commission agenda took up the subject application. <br />GALDONES:Commissioners, I note that there is a representative for application No. 1, <br />so were going to take it out of order and bring it up at this point in time. <br />1 <br /> <br />
