Sam Kawamura seconded.
Curtis Tyler indicated that the first paragraph of page 3 should be corrected to read as follows: willing to subsidize this through the
General Fund and DOH has suggested that this is a violation of the State Revolving Loan Terms.
Motion to approve the minutes with the correction mentioned above was carried unanimously.
STATEMENTS FROM THE PUBLIC ON ITEMS LISTED ON AGENDA
Curtis Tyler, Councilmember:
Suggested that the minutes be available on the Web. Made formal request to be put on the mailing list for the agenda and minutes.
As an agency, we are required to maintain a list for members of the public who are interested in getting materials. The public is
entitled to notice. The Mission Statement looks good.
APPROVAL OF ADDENDUM AND/OR SUPPLEMENTAL AGENDA
Hugh Ono motioned for discussion for adequate notice regarding the Sunshine Law be added to the Agenda, seconded by Carolyn
Witcher. Motion was unanimously carried.
Hugh Ono: The objective should be to get the information out to the general public in adequate time so that they can address the
issue. I understand that the Sunshine Law requires government to furnish written materials upon request and allows any individual
to be put on our mailing list. With regard to adequate notice, does posting it on the Website constitute statutory publication?
Pat O’Toole: I don’t think our statutes have caught up with the electronic notices yet. And let me just talk on what the statutes says
about mailing. It says the board shall maintain a list of names and addresses for persons who request notification of meetings and
shall mail a copy of the notice to such persons at their last recorded address no later than the time the agenda is filed with the clerk.
So you just have to mail the agenda at the same time you’re going to post it. Of course, you can always go beyond that and mail
out the other additional information as well. This is what you are minimally required to do. Keep a list of the names and addresses
of people who are asking for the agenda to be sent to them.
file://C:\Test1\minutes070301.htm6/22/2011
