<br />Minutes for Wednesday, November 28, 2001Page 1 of 3 <br />Return to: Home Page | Table of Contents | Commission Page <br />ENVIRONMENTAL MANAGEMENT COMMISSION <br /> <br />Wednesday, November 28, 2001 <br />8:35 a.m. <br />Waimea Community Center (Park) Building <br />65-1260 Kawaihae Road, Kamuela, Hawai`i 96743 <br />PRESENT:Riley SmithALSO PRESENT:Dante Carpenter <br />Barbara BellChristine Ross <br />Hugh OnoSteve Cassulo <br />Peter MartinFred Brunner <br />Sam KawamuraJohn Ray <br />David FrankelElden Conley <br />Carolyn WitcherJon Olson <br />Bob Platt <br />EXCUSED:Luana JonesDale Burton <br />Mack Asato <br />STAFF:Galen Kuba <br />Peter Boucher <br />Larry Capellas <br />Kathy Garson <br />Kristen Griffiths <br />1.CALL TO ORDER <br />Riley Smith called the meeting to order at 8:35 a.m. <br />2.APPROVAL OF MINUTES OF OCTOBER 24, 2001 MEETING <br />Carolyn Witcher moved to clarify the minutes concerning sewer user fees by being more specific. <br />Barbara Bell seconded the motion. <br />Carolyn indicated that the first paragraph of page 4 should be corrected to read as follows: "…Having that in <br />the Code is helpful to the Commission because it does potentially give the Commission the right to do it. <br />Right now the Council has assumed that duty. It will be a couple step process. Council needs to repeal their <br />schedules that they have and make a clearer delegation of this authority to this Commission. Right now under <br />the Charter and the Rules for the Department of Environmental Management, there is no clear mandate to the <br />Commission. The Commission is really to advise the Department. The Commission doesn’t have any rate <br />setting powers, but that can be delegated to this Commission by the Council if they so choose." <br />Motion to approve the minutes with the corrections mentioned above was unanimously carried. <br />3.STATEMENTS FROM THE PUBLIC ON ITEMS LISTED ON AGENDA <br />There were no statements from the public. <br />4.APPROVAL OF ADDENDUM AND/OR SUPPLEMENTAL AGENDA <br />Hugh Ono moved to modify Item No. 7 on the agenda to read Jurisdictional Limitation of the <br />Environmental Management Commission and Letter Submitted by Jerry Rothstein. Barbara Bell <br />seconded the motion. Motion was unanimously carried. <br />David Frankel motioned to include the topic of "Future Agenda Items" on all agendas.
