<br />PLANNING COMMISSION <br />COUNTY OF HAWAI‘I <br /> <br />HEARING TRANSCRIPT <br />APRIL 5, 2012 <br /> <br />A regularly advertised hearing on the PLANNING DIRECTOR INITIATED AMENDMENT CHAPTER 25 <br />(ZONING CODE) OF THE HAWAI‘I COUNTY CODE 1983 (2005 EDITION, AS AMENDED) RELATING <br />TO BED AND BREAKFAST ESTABLISHMENTS was called to order at 9:32 a.m. in the County of Hawai‘i, <br />Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Zendo Kern presiding. <br /> <br />COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Takashi Domingo, Wallace Ishibashi, Stephen Ono <br />and Raylene Moses <br /> <br />STAFF PRESENT: Ivan Torigoe (Deputy Corporation Counsel), B. J. Leithead Todd (Planning Director), <br />Daryn Arai (Planning Program Manager), Maija Cottle (Staff Planner), Jeff Darrow (Staff Planner), and Sharon <br />Nomura (Secretary) <br /> <br />And three people from the public in attendance. <br /> <br />APPLICANT: PLANNING DIRECTOR INITIATED <br /> <br />Amendment to Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition, as amended) <br />relating to bed and breakfast establishments. The proposed amendment will specifically amend Sections 25-2- <br />61(a), 25-2-71(c), 25-2-76(b through e), 25-4-7(a), 25-5-52(d), 25-5-62(d) and 25-5-72(d). This is a <br />housekeeping matter that seeks to provide consistency among different sections of the Zoning Code relating to <br />bed and breakfast establishments. <br /> <br />KERN: Application No. 3, Planning Director initiated amendment to Chapter 25 <br /> relating to bed and <br />breakfast establishments. Jeff. <br /> <br />DARROW: Our next application, the Planning Director is recommending that this be deferred, not to a specific <br />date. What has happened again, we’ve come across a situation just recently where in the process of amending <br />one bill, another bill going up to Council would have an effect on this bill. So that recent bill that we had sent <br />up to Council regarding changes to mortuaries and crematoriums will have an effect on this particular bill. So <br />we’ve been advised to wait until that passes. And then this bill can go up clean, and then we’d be able to not <br />have conflicts. So we’re requesting just an open-ended deferral until that bill passes, and then we would place it <br />back on the Planning Commission’s agenda. <br /> <br />KERN: Okay, very good. Thank you, Jeff. Any questions for staff? We do have two people signed up to <br />testify from the public. So we’ll give them that opportunity since they are already here, or one of them <br />representing the other one, I believe. So Debbie Ward and Cory Harden please come forward. <br /> <br />HARDEN: No, we won’t testify. <br /> <br />KERN: Okay, they’re not going to testify.
