<br />A regularly advertised hearing on the application of ROYAL ALII LLC (SMA 05-007) was
<br />called to order at 9:42 a.m. in the West Hawai‘i Civic Center, Community Center, Building G,
<br />74-5044 Ane Keohokālole Highway, Kailua-Kona, Hawai‘i, with Chairman Keith F. Unger
<br />presiding.

<br />COMMISSIONERS PRESENT: Keith F. Unger, Collin Kaholo, Nancy Carr Smith,
<br />Barbara Nobriga and Sonny Shimaoka
<br />
<br />ABSENT AND EXCUSED: Scott Church and Perry Kealoha
<br />
<br />ALSO PRESENT: Danny Patel (Counsel for the Commission), Duane Kanuha (Planning
<br />Director), Daryn Arai (Planning Program Manager), Jeff Darrow (Planner), Maija Jackson
<br />(Planner), Christian Kay (Planner) and Noriko Sauer (Commission Secretary)

<br />APPLICANT: ROYAL ALII LLC (SMA 05-007)
<br />Request to amend Condition No. 2 (additional time to secure Final Subdivision Approval) of
<br />Special Management Area Use Permit No. 05-007, originally approved on July 21, 2006, to
<br />allow a 19-unit, single-family residential development and related uses. The properties are
<br />located on the east (mauka) side of Ali‘i Drive, across from the ʻAlohi Kai Subdivision and
<br />Kamoa Point, Kaumalumalu, North Kona, Hawai‘i, TMK:7-7-004:057 & 058.

<br />UNGER: Second agenda item, Item No. 2, Applicant Royal Ali‘i LLC, SMA 05-007, request to
<br />amend Condition 2, additional time to secure Final Subdivision Approval, of SMA Use Permit
<br />05-007, originally approved on January \[July\] 21, 2006, to allow a 19-unit single-family
<br />residential development and related uses. The properties are located on the east, on the mauka,
<br />side of Ali‘i Drive, across from ‘Alohi Kai Subdivision and Kamoa Point, Kaumalumalu, North
<br />Kona, Hawai‘i, TMK 7-7-004:057, Parcels 57 and 58.

<br />hear the presentation, and then after that we’ll deal with the petition for standing. So go ahead,

<br />DARROW: Thank you very much, Mr. Chairman. Good morning, Members of the Planning
<br />Commission, Mr. Chairman. If I can direct your attention to our next presentation. As
<br />mentioned, the applicant is Royal Ali‘i LLC, and they are requesting an amendment to Special
<br />Management Area Use Permit No. 05-007. The area of the subject application is within the
<br />North Kona District of Hawai‘i. More specifically, we are looking along Ali‘i Drive, which runs
<br />in a north-south direction. For reference we also have Kuakini Highway that runs parallel with
