BRIAN SUGAI <br /> AMENDMENT TO CHANGE OF ZONE ORDINANCE 10 019 (REZ 09-101) <br /> DR.BRIAN SUGAI submitted an application for a six(6)-year time extension to Condition D <br /> (Time to Complete Construction) of Ordinance No. 10 019, which reclassified approximately <br /> one(1) acre of land from an Agricultural 1-acre(A-la)to Neighborhood Commercial-20,000 <br /> square feet(CN-20)zoning district. The subject property is located adjacent to the Alenaio <br /> drainage channel on the east side of Komohana Street approximately 700 feet south of the <br /> Komohana Street-Ponahawai Street intersection, Ponahawai, South Hilo, Hawai`i, <br /> TMK: 2-3-037:019. <br /> PROPOSED DEVELOPMENT <br /> 1. Applicant's Request: The applicant is requesting a six(6)-year time extension to <br /> Condition D (Time to Complete Construction), which states: <br /> "Construction of the proposed improvements shall be completed within five(5)years <br /> from the effective date of this ordinance. This time period shall include securing Final <br /> Plan Approval from the Planning Director in accordance with Section 25-2-70, Chapter <br /> 25 (Zoning Code), Hawai`i County Code. Plans shall identify all proposed structure(s), <br /> fire protection measures,paved driveway access,parking stalls and loading zones. <br /> Landscaping shall be indicated on the plans for the purpose of mitigating any potential <br /> adverse noise or visual impacts to adjoining parcels. Landscaping shall be provided in <br /> accordance with the requirements of Planning Department's Rule No. 17(Landscaping <br /> Requirements). " <br /> Please note, the applicant initially requested a five(5)-year time extension with the <br /> possibility of retaining an administrative time extension,however,based on <br /> conversations with the Planning Department staff, the applicant changed the request to a <br /> six(6)-year time extension with no administrative time extension. <br /> 2. Proposed Development: The applicant initially planned to construct an approximately <br /> 20,000-square foot, two-story building to contain his medical office and other offices for <br /> rent/lease on the ground floor and a residential unit on the second floor to be used by the <br /> applicant. The original plan also set aside an area on the property for an additional <br /> 20,000-square foot building. However,due to cost considerations,the applicant decided <br /> -1- <br />
