Pursuant to Condition Z, a 5 -year time extension to August 5, 2015 was <br />granted by the Planning Director in a letter, dated September 6, 2011. <br />(Exhibit C) <br />The applicant who is the same owner of the property, Suffolk Investment <br />LLC, is now proposing to amend: <br />a) Condition B by allowing payment of the water commitment fee, <br />if necessary, within 120 days from the effective date of this <br />amended ordinance; <br />b) Condition C by requiring construction to commence within 5 <br />years and completed within 10 years from the effective date of <br />this amended ordinance; <br />c) Condition D by deleting the rental housing restriction and <br />letting the requirements of the County affordable housing code <br />prevail; <br />d) Condition E by deleting only that portion that requires a <br />supplemental Traffic Impact Analysis Report if deemed <br />necessary by the State Department of Transportation; <br />e) Condition F by modifying and/or deleting portions that have <br />already been implemented; <br />f) Condition H by allowing the possibility of changing the location <br />of the Spine Road within the project site and at its intersection <br />with Kuakini Highway, subject to the approval of the County <br />Department of Public Works; <br />g) Condition I, because of the proposed amendment to Condition <br />H, making some consistent editorial change; <br />h) Condition U by deleting the obligation to provide a 5 -acre <br />school site; J <br />i) Condition V by modifying the fair share requirement consistent <br />with the deletion of Condition U; <br />j) Condition X to modify the affordable housing requirement by <br />relying on the requirements of the County affordable housing <br />code and changing the authority from the County Housing <br />Agency to the Administrator of the Office of Housing and <br />Community Development;. and <br />k) Condition Z by allowing ari administrative extension using the <br />date of the amended ordinance. <br />2 <br />
