The State Department of Transportation ("DOT") will have an <br />opportunity to comment on the requested amendments, including the <br />review of the updated TIAR which is found in Exhibit D. During the <br />course of its. review, it can recommend certain improvements be made. <br />Notwithstanding that ability, please note that the Queen Ka'ahumanu <br />Highway intersection falls under the jurisdiction of the State DOT, and <br />its requirements Must be complied with, with or without any rezoning <br />conditions. Accordingly, since the DOT already has the ability to <br />control the project's road and access infrastructure destiny relative to <br />the State highway, the applicant is requesting that this portion of the <br />condition be deleted. <br />Further, as currently written, it would suggest that the DOT would have <br />the ability to determine all road related improvement requirements for <br />the project, including Kuakini Highway (which falls under the County's <br />jurisdiction) and the proposed interior road. The applicant requests <br />that DOT's jurisdiction be limited to only that portion of the Queen <br />Ka'ahumanu Highway fronting the subject site. <br />F. The applicant, successors, or assigns shall improv"e the intersection <br />at the principal access on the Hawaii Belt Road at the north end of <br />T M. K.: No. 7-5-17: 1 at the Pualani Estates Subdivision Road, <br />including but not limited to, a deceleration and exclusive left -tum <br />lane into T. M. K tilo. 7-5-17: 1. The applicant shall pay for the cost <br />of upgrading the traffic signal lights at the intersection of the Hawaii <br />Belt Road and the Pualani Estates Subdivision Road to <br />accommodate 4 -way traffic. Said improvements, plus the main <br />spine road through the Pualani Estates Subdivision to Hualalai <br />road, shall be completed prior to the issuance of a certificate of <br />occupancy for non-residential structures or final inspection of any <br />residential structures. <br />The applicant will comply with this requirement. However, it would like <br />to propose some minor edits to reflect the road improvement approving <br />entity (State DOT) as well as the already completed road connection. <br />
