E. Historic/Cultural/Archaeological Resources <br /> As the site was formerly cleared and used for sugar cane and now for <br /> fruit bearing and equestrian activities, no commissioned <br /> archaeological survey of the site was made. As such, the Applicants <br /> do not believe that the site has any archaeological features. <br /> However, in the event any inadvertent discoveries are made during <br /> any land disturbance activity relating to this project, work will cease, <br /> and the applicant will immediately notify the Planning Department and <br /> the State DLNR and secure their clearances before proceeding <br /> further. <br /> G. Valued Cultural Resources <br /> In view of the recent Hawaii State Supreme Court's "RASH" and "Ka <br /> Pa'akai 0 Ka'Aina decisions, the issue relative to native Hawaiian <br /> gathering and fishing rights must be addressed. Specifically, there <br /> must be a discussion of the cultural, historical, and natural resources <br /> and associated tradition and customary practices of this site. <br /> In this situation, the subject site is not adjacent and/or proximate-to the <br /> shoreline. As such, gathering of marine life and coastal access is not <br /> an issue. <br /> It is not known whether the subject or immediate surrounding area <br /> was used in the recent past for the gathering of plants by native <br /> Hawaiians. The Applicants have not observed any native Hawaiians <br /> on the site or adjoining properties gathering plants in recent times. <br /> Thus, it would appear unlikely that the site would serve such purpose <br /> today. <br /> In the event legitimate gathering claims are made by native <br /> Hawaiians, the Applicants intend to respect and honor such claims <br /> and provide the needed access within the site. <br /> Based on the above, it does not appe-ar that the project would have <br /> any potential adver,se impact relative to the cultural and historical <br /> resources of the area which cannot otherwise be mitigated. <br /> H. Water and Coastal Resources <br /> The subject site is located well over two (2) miles from the coastline. <br /> 13 <br />
