For this reason, the Project Site is not subject to any coastal hazard nor anticipate to have any adverse impact upon coastal resources. There is no record of a designated public access that traverses the Project Site. As the Project Site had been previously cultivated in sugar cane, it is not anticipated that the proposed request will have any adverse impact on cultural or historical resources in the area. In view of the Hawaii State Supreme Court's "PASH"° and "Ka Pa`akai Q Ka`Aina" decisions, the issue relative to native Hawaiian gathering and fishing rights must be addressed in terms of the cultural, historical, and natural resources and the associated traditional and customary practices of the site. As the Project Site has been previously disturbed through past cultivation of sugar cane and since overgrown with non-native plants and invasive species of both plants and animals, it is unlikely that there are any valued cultural, historical, and natural resources to be found. For this reason,the Applicant could find no evidence of any possible adverse effects or impairments that will occur to any valued resources should this change of zone request be approved.
