May 9, 2023, HSAC Meeting Minutes Page 16 <br /> SO/6:: <br /> HB117 Relating to the Regulation of Tobacco Products. <br /> SB208 Relating to the Regulation of Tobacco Products. <br /> Repeals section 328J-11.5, Hawaii Revised Statutes., to reauthorize the counties to enact <br /> restrictions on the sales of tobacco products. <br /> Outcome: SB 1447, became the vehicle for tobacco, proposed to allow the counties to <br /> adopt ordinances that regulate the sale of cigarettes, tobacco products, and electronic <br /> smoking devices that do not conflict with and are more stringent than the state law that <br /> govern smoking. SB 1497 was not passed because section 328J-15, HRS, which is <br /> substantially similar to section 3 of SB 1447 reads: <br /> HB118 Relating to Traffic Fines. <br /> SB209 Relating to Traffic Fines <br /> Clarifies that each county may, by ordinance, designate certain sections of county <br /> highways as areas in which stopping, standing, or parking vehicles is prohibited or <br /> restricted. <br /> HB 118 was amended to provide that any federal or state agency authorizing a road <br /> closure shall preempt a county ordinance. <br /> Outcome: Passed by the Legislature; transmitted to the Governor. <br /> HCR3 REQUESTING THE DEPARTMENT OF HEALTH TO ADOPT RULES FOR A <br /> PERMIT TO DISCHARGE POLLUTANTS THAT INCLUDE THE MAJOR FACTORS <br /> THAT ARE CONSIDERED IN IDENTIFYING THE FUNCTIONAL EQUIVALENT OFA <br /> DIRECT DISCHARGE FOR POINT SOURCES OR NONPOINT SOURCES. <br /> Outcome: HCR 3 was deferred by the House Committee on Energy & Environmental <br /> Protection. <br /> Jon suggests for the next session we start planning earlier and work with him on drafting <br /> the language so they can get the weigh in from the department heads beforehand. <br /> ED Parsons:Legislative timeline discussion and review. <br /> V. UNFINISHED BUSINESS <br /> a. Communication (03/31/2023) from Treasurer Tommy Waters, City and County of <br /> Honolulu, request for agenda time to discuss HSAC. 2024 Bylaw Amendments. <br /> (Deferred April 14, 2023) <br /> CM Waters: Review of the amendments being proposed. Adding language to allow the ED to <br /> conduct duties in support of the HSAC officers. Amendment regarding changing "shall" to <br /> "may"for whether HSAc is subject to HRS 92. <br />
