STATE OF HAWAII <br />TIME OF PERFORMANCE <br />-DRAFT- <br />1. Time of Performance <br />Attachment 3 <br />The tasks described in Attachment 1, Scope of Services, shall be performed by the <br />CONTRACTOR between the start date provided in the Notice to Proceed ("NTP") letter and <br />end twenty-four (24) months from the NTP start date, except that the final report and final <br />fiscal report as specified below shall be submitted no later than thirty (30) days thereafter, <br />unless this Contract is terminated earlier, extended as provided herein or when the funds <br />provided have been fully expended. <br />2. Termination <br />In addition to the termination provisions in the General Conditions, the STATE reserve the <br />right to cancel the CONTRACT at any time should the CONTRACTOR not show reasonable <br />progress with achieving the objectives of the CONTRACT. <br />3. Extension <br />This Contract may be extended in accordance with AG-008 103D General Conditions, <br />paragraph 19, Modification of Contract, or other applicable provision for not more than one <br />(1) additional 12-month period or portion thereof at the same rate. The CONTRACTOR shall <br />submit an extension request in writing for the STATE approval a minimum of sixty (60) days <br />prior to the expiration of the Contract. The request shall provide detailed reasons for the <br />delay in and steps to be taken to ensure the timely completion of the project. If the STATE <br />approves the extension request, a Supplemental Contract shall be executed by both parties <br />in accordance with the General Conditions. The CONTRACTOR shall not be entitled to any <br />additional compensation to complete the work described in the primary Contract. <br />AG-013 <br />
