The County Council reserves the right without prejudice to cancel or reject any or all <br /> proposals and to waive any defects in the proposals or Notification, in the best interest <br /> of the County. <br /> Unless otherwise expressly provided in the contract, all provisions of these <br /> specifications and instructions shall be considered to be part of the contract entered <br /> into by the County and the Contract Auditor. Additionally, the County's standard <br /> General Terms and Conditions for contracts will be included in the contract. <br /> The County shall have the right to suspend performance of the services under the <br /> contract or terminate the contract in whole or in part at any time by written notice to <br /> the Contract Auditor with good cause. <br /> The successful proposer must apply to the Hawaii State Tax office and the Internal <br /> Revenue Service in conformance with HRS, 103-53, for a tax clearance prior to a <br /> contract being issued and again before final annual payment can be made. In the event <br /> an apparent successful proposer is unable to furnish appropriate certificates within ten <br /> (10) calendar days of being requested to do so, the County will proceed to award the <br /> contract to the next most acceptable proposer who shall furnish said certificates. It is <br /> not required, but strongly suggested, that proposers furnish tax clearances with their <br /> proposals. <br /> In conducting the Single Audit of Federal assisted programs, small business concerns <br /> and business concerns owned and controlled by socially and economically <br /> disadvantaged individuals are encouraged to participate in the performance of the <br /> contract awarded to fulfill the audit requirements of Chapter 75, Title 31, United <br /> States Code. <br /> D. Arakaki, c/o Purchasing Division, Room 118, 25 Aupuni Street, Hilo, <br /> Hawaii 96720. The proposal must be received by the Purchasing Division <br /> 4:00 p.rn. on October 31, 2001.
