r':: <br /> <br /> r <br /> 7 The Director is authorized to investigate the financial status, <br /> experience, equipment and records of each bidder. The Director <br /> is further authorized to require any other appropriate evidence <br /> and information from any bidder that relates to its ability to <br /> perform its obligations under this Contract. <br /> 8. All bids received will be time-stamped and deposited in the <br /> locked bid box of the Purchasing Division until the'hour of bid <br /> opening. Bids that are mailed must arrive in the Purchasing <br /> Division before the time of opening; bids received after the <br /> hour of opening will be returned unopened to the sender. The <br /> bidder is solely responsible for the timely arrival of its bid. <br /> 9. The successful bidder must execute and submit with the final <br /> invoice for payment, the Non-Gratuity Affidavit, duly notarized. <br /> 10. All Contractors must apply to the Hawaii State Tax Office for a <br /> tax clearance and submit approval to the County using agency <br /> before final payment can be made. <br /> 11. This being a price term agreement, Section 3.3 of the General <br /> Conditions is hereby amended to require an amount of $50,000.00 <br /> as a performance bond. Said performance bond shall remain in <br /> full force and effect a minimum of two (2) years following the <br /> completion of the contract, including any optional years <br /> accepted. <br /> 12. The Contractor agrees to indemnify and hold harmless the County, <br /> its officers, agents, and employees from any and all actions, <br /> claims, proceedings, costs, fees, damages, and losses resulting <br /> from injury to personnel or private property arising out of or <br /> in connection with the labor and services to be performed by the <br /> Contractor under this Contract, including but not limited to <br /> claims for injuries to the Contractor's agents, servants, <br /> employees or other persons, or property. <br /> SPECIAL PROVISIONS - 2 <br /> <br />
