<br /> COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 26Z (?4 <br /> <br /> RESOLUTION AUTHORIZING THE (I) EXTENSION OF THE PUBLIC SEWER FROM <br /> <br /> ALIT DRIVE MAUKA AND ACROSS WALUA ROAD; AND (2) REIMBURSEMENT FOR <br /> <br /> THE COST OF CONSTRUCTION OF THE EXTENSION BY BOLTON, INC. AT WAI'AHA, <br /> <br /> NORTH KONA, HAWAII. <br /> WHEREAS, applicant Bolton, Inc. has submitted an application to extend the public sewer from <br /> Ali'i Drive mauka across Walua Road in accordance with Section 21-26, Hawaii County Code, with <br /> said application and construction plans being attached hereto as Attachment "A' ;and <br /> WHEREAS, sewer extensions aze beneficial to the community by eliminating existing cesspools <br /> and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in <br /> cleaner, healthier envirorunent; and <br /> WHEREAS, Section 21-26, Hawaii County Code, requires that all sewer extensions shall be <br /> approved by resolution of the County Council, and <br /> WHEREAS, applicant, Bolton, Inc., has proposed to construct the extension in accordance with <br /> Section 21-28(a) Hawai i County Code, regarding payment of costs; and <br /> WHEREAS, the Director of the Department of Environmental Management has already <br /> approved the plans for the extension; and <br /> WHEREAS, in accordance with Section 21-28(a), Hawaii County Code, the applicant may <br /> receive for ten years afrer completion of the extension one-half of all moneys for sewer chazges <br /> collected by the County from other properties connecting to the extension, provided the total of such <br /> reimbursements shall not exceed the cost incurred by the applicant to construct the extension, and plans <br /> to reimburse applicant for construction of sewer extensions shall require the approval of the County <br /> Council by resolution. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii that the <br /> sewer extension from Ali'i Drive mauka across Walua Road by Bolton, Inc. is hereby approved. <br /> BE IT FURTHER RESOLVED that the request of Bolton, Inc. to be reimbursed for the cost of <br /> the sewer extension from Ali'i Drive mauka across Walua Road in accordance with Section 21-28(a), <br /> Hawaii County Code, is hereby approved. <br /> <br />
