Section 3-31. Projections beyond property line. <br /> No sign or portion of any sign, except for marquee or projecting signs, may project over any public area or way <br /> outside of the property line upon which the sign is located. No sign shall be permitted to interfere with vehicular <br /> <br /> traffic or project over any public street except as may be permitted in Section 3-9. <br /> Section 3-32. Distance above ground of projecting signs. <br /> The lower edge of any sign projecting over any public area, except a marquee sign, shall have a vertical <br /> clearance of not less than nine feet. <br /> Section 3-33. Height above buildings. <br /> The highest point on any sign attached to a building or structure shall not extend above the highest part of the <br /> building or structure to which it is auached. <br /> Division 10. Maintenance <br /> Section 3-34. Maintenance specifications. <br /> <br /> (a) All signs, together with their framework, braces, angles or other supports, shall be: <br /> (I) Maintained in a safe structural condition, properly secured, supported and braced; <br /> (2) Maintained in compliance with all building and electrical codes, and in conformance with this <br /> chapter at all times; and <br /> (3) Properly maintained with exposed surfaces kept clean and painted if paint is required and defective <br /> parts replaced. <br /> Division 11. Nonconforming Signs <br /> Section 3-35. Signs erected prior to the effective date of this chapter. <br /> (a) Any sign erected prior to the effective date of this chapter, in compliance with all then existing statutes, <br /> ordinances, and regulations, and for which a legal permit had been obtained, is permitted to be <br /> maintained as a nonconforming sign until such time that the sign is altered, relocated, or the business is <br /> sold, at which time it must be removed or brought into compliance with all provisions of this chapter. <br /> Any person who fails to comply, as indicated in Section 3-36 (Violations) and Section 3-3A and 3-42 <br /> (Administrative enforcement and Criminal prosecution) shall be sentenced to pay a fine of $100 per day <br /> from the final date specified for correction of the violation. During the time a sign is permitted to <br /> remain as a nonconforming sign, it is subject to the following conditions: <br /> (I) A nonconforming sign shall be maintained in a safe condition and shall not in any respect be <br /> dangerous to the public or to property. <br /> (2) At such time that the nonconforming sign is altered, relocated, or the business is sold, or the <br /> discontinuance or removal from the premises of the activity to which the sign relates, the sign <br /> ceases to be a nonconforming sign and shall thereafter be allowed to be maintained only upon <br /> -19- <br /> <br />
