Arakaki, Chairman <br /> and Members of the County Council <br /> Page 2 <br /> The applicant was given the option of having the Planning Commission vote on the <br /> application at a subsequent meeting or have the matter referred to the County Council. <br /> The applicant elected to have the application be forwarded to the County Council. <br /> Accordingly, we are hereby transmitting this letter that explains the unfavorable <br /> recommendation of the Planning Commission. The favorable recommendation of the <br /> Planning Director, along with the proposed bill and the Planning Department's <br /> Background Report and Recommendation, are also being included. <br /> For your information, the applicant requested Condition E be amended to read, "Any <br /> vehicular gate shall be set back a minimum of 60 feet from the existing right-of--way of <br /> Palani Road if agreed to by all lot owners within the Pamahoa Estates Subdivision," <br /> inasmuch as their attorney stated that they would need a unanimous agreement of the lot <br /> owners to install such a gate.
