CTAHR shall designate a principal investigator to <br /> be responsible for conducting the research and scientific <br /> management of the Quarantine Program in accordance with <br /> University of Hawaii policies and procedures. Lessee shall <br /> designate a project co-investigator to be responsible for <br /> supervising the administrative management of the Quarantine <br /> Program. The DOA shall designate a project co-investigator to be <br /> responsible for working with CTAHR's principal investigator and <br /> the County's co-investigator to implement the Quarantine Program. <br /> The CTAHR investigator, Lessee's co-investigator and the DOA <br /> co-investigator shall cooperate with RCUH on administrative <br /> aspects of the Quarantine Program. <br /> I. DEMISE <br /> 1.01 Demise. Lessor, in consideration of the rent <br /> reserved in this Lease and of the covenants contained in this <br /> Lease and on the part of Lessee to be observed and performed, <br /> hereby demises and leases unto Lessee, and Lessee hereby accepts <br /> and rents from Lessor: <br /> All of the real property described in Exhibit A <br /> attached to this Lease (the "Premises"). <br /> SUBJECT, HOWEVER, to the encumbrances described in <br /> Exhibit A, and to the following reserved rights: <br /> (a) Water Rights. The right unto Lessor, Lessor's <br /> agents and any permittees or grantees of Lessor, from time to <br /> time to enter the Premises with any necessary equipment and to <br /> prospect, dig, bore, drill and tunnel for water thereon, to drill <br /> and develop wells, to divert, collect and impound any water so <br /> developed and to construct, maintain, repair and replace thereon <br /> any dams and reservoirs to collect and impound such water and any <br /> ditches, flumes and pipelines necessary to conduct such water <br /> from the Premises; provided, however, that this right shall be <br /> exercised in such manner as to occasion the least practicable <br /> interference with the use of the Premises by Lessee. Lessee <br /> shall have no right to drill or develop wells on the Premises <br /> without the prior written consent of Lessor, for which consent <br /> Lessor may charge consideration. <br /> (b) Access. The right unto Lessor, Lessor's other <br /> tenants of adjoining lands and such other persons who now have or <br /> are hereafter granted rights of access to adjoining lands, to use <br /> in common with Lessee all roads and trails from time to time <br /> existing and maintained on the Premises. Lessor's reservation of <br /> any such access should be considered only recognition that a <br /> claim of access or right to use a particular route may be made by <br /> a third party, but not an admission by Lessor that any third <br /> party has any right to use such access.
