<br /> C. Construction of the proposed development shall be completed within five <br /> (5) years from the effective date this ordinance. Prior to construction, the <br /> applicant, successors ~or assigns shall secure Final Plan Approval for the <br /> proposed development from the Planning Director in accordance with <br /> Section 25 ?-70, Chapter 25 (Zoning Code), Hawaii County Code. Plans <br /> shall identify all existing and/or proposed structures, paved driveway <br /> access and parking stalls associated with the proposed development. <br /> Landscaping shall also be indicated on the plans for the purpose of <br /> mitigating any adverse noise or visual impacts to adjacent properties in <br /> accordance with the requirements of Planning Department's Rule No. 17 <br /> (Landscaping Requirements). <br /> <br /> D. As represented by the applicant, the project shall be restricted to the use of <br /> rental housing only far a period of not less than 20 years from the issuance <br /> of a certificate of occupancy. Any change to this condition will require an <br /> amendment to the change of zone ordinance. <br /> E. If Department of "transportation requires an amended Traffic Impact <br /> Analysis Report ("LIAR), it shall be submitted to the Department of <br /> Transportation for review and approved prior to the issuance of Final Plan <br /> Approval nll accesses, including roadway and/or intersection <br /> improvements, shall rneet with the approval of the Department of <br /> 1 ransportation. <br /> F. The applicant, successors, or assigns shall improve the intersection at the <br /> principal access on the Hawaii Belt Road at the north end of T.M.K. No. <br /> 7-5-17:1, at the Pualani Estates Subdivision Road, including, but not <br /> limited to, a deceleration and exclusive left-turn lane into T.M.K. No 7-5- <br /> 17: 1. Intersection improvements shall be as required by the Department <br /> of Transportation. The applicant shall pay for the cost of upgrading the <br /> traffic signal lights at the intersection of the Hawaii Belt Road and the <br /> -It- <br /> <br />
