COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAII <br />BILL NO. <br />(Draft 6) <br />AN ORDINANCE AMENDING CHAPTER 4 OF THE HAWAII COUNTY CODE 1983 <br />(2005 Edition), ANIMALS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. The purpose of this measure is to repeal Chapter 4, Animals, Hawaii County <br />Code, and to set out a new chapter regarding animals. <br />SECTION 2. Chapter 4, Hawaii County Code 1983 (2005 Edition), is repealed. <br />SECTION 3. The Hawaii County Code 1983 (2005 Edition) is amended by adding a new <br />chapter to read as follows: <br />"Chapter 4 <br />ANIMALS <br />Article 1. Administration Provisions <br />Section 4-1. Definitions. <br />As used in this chapter: <br />"Abandon" means to voluntarily release possession of an animal with the intent, or apparent <br />intent, of never again claiming an ownership or possessory interest in the animal. <br />"Animals," unless provided otherwise, include but are not limited to domesticated animals, <br />farm animals, poultry and those animals that are customary and usual pets such as dogs, cats, <br />rabbits, birds, and other beasts which are maintained on the premises of a dwelling unit and kept <br />by the resident of a dwelling unit solely for personal enjoyment and companionship, such as, <br />without limitation, for a hobby, for legal sporting activities, and for guarding of property; <br />animals exclude aviary game birds and fish as defined in the Hawaii Revised Statutes. <br />"Animal care center" means a nonprofit organization that is exempt from taxation pursuant <br />to section 501(c) of the Internal Revenue Code, 26 U.S.C., as amended formed for the purpose of <br />prevention of cruelty to animals. <br />"Animal control officer" means any employee or trained volunteer of a county -contracted <br />animal control services provider or the Hawaii County police department who is authorized to <br />carry out and enforce the provisions of this chapter. Such individual shall also be known as and <br />may bear the title of "enforcement officer." <br />
