County of Hawaii <br />PLANNING COMMISSION <br />Aupuni Center • 101 Pauahi Street, Suite 3 • Hilo, Hawaii 96720 <br />Phone (808) 961-8288 • Fax(808)961-8742 <br />January 24, 2006 <br />Stacy Higa, Chairman <br />and Members of the County Council <br />County of Hawaii <br />25 Aupuni Street <br />Hilo, HI 96720 <br />Dear Chairman Higa and Council Members: <br />Change of Zone Application (REZ 05-016) <br />Applicant: Janice Oshiro <br />Request: RS -10 to CG -10 <br />Tax Map Key: 2-2-28:30, 32, 33 <br />The Planning Commission at its duly held public hearing on January 6, 2006, considered <br />the Change of Zone application filed by Janice Oshiro for approximately 28,002 square <br />feet of land from a Single Family Residential -10,000 square foot (RS -10) to a General <br />Commercial -10,000 square foot (CG -10) district. The property is located along the east <br />side of Kilauea Avenue and approximately 120 feet north of the Kilauea Avenue- <br />Lanikaula Street intersection, Waiakea, South Hilo, Hawaii. <br />A motion was made to send a favorable recommendation with amendments to the County <br />Council. There were four votes in favor of the motion and two against. No other <br />motions were made. <br />The four to two vote constitutes a "no action" by the Planning Commission because of <br />the lack of the five affirmative votes required by Hawaii County Charter, Section 134(I). <br />Under Section 25-2-42(d)(3) and Planning Commission Rules 11-3(b)(2), the Planning <br />Commission's non -action constitutes an unfavorable recommendation. Therefore, the <br />application is being forwarded to you with this unfavorable recommendation, along with <br />a copy of the hearing transcript. <br />We are also enclosing a copy of the Planning Department's Background Report and <br />favorable recommendation, as well as an amendment to Section 25-8-33 (City of Hilo <br />Zone Map), of the County Zoning Code for your consideration. <br />Hawaii County is an Equal Opportunity Provider and Employer <br />
